1. Acceptance of Terms

Welcome to Photoboo ("Photoboo"), an iOS/iPadOS application developed by Imagnet ("we," "our," or "us"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Photoboo is a professional AI-powered photo booth application for iPad. The App allows users to capture photos using the iPad camera or a connected Canon camera, apply AI-powered photo transformations and effects, and share or print the results. The AI photo transformations are processed using third-party cloud-based APIs via secure encrypted connections (HTTPS).

3. Subscriptions and AI Credits

The App offers the following in-app purchase options:

• Auto-Renewable Subscriptions: Monthly or annual subscription plans that provide access to premium features and a recurring allocation of AI credits. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• AI Credit Packs: One-time purchases of AI credits that can be used for AI photo transformations. Each AI photo transformation consumes 1 credit.

All payments are processed exclusively through Apple's App Store. By subscribing, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

4. AI Photo Transformation Service

The App uses third-party artificial intelligence APIs to process and transform photos. By using the AI features, you acknowledge and agree that:

• AI-generated results may vary and are not guaranteed to meet specific expectations.
• Images submitted for AI processing are transmitted securely via HTTPS encryption.
• Images are processed in real-time and immediately deleted from our servers once returned to your device.
• We do not use your photos or face data to train or fine-tune AI models.
• AI credits are consumed when a transformation is initiated and are non-refundable once used.
• The AI service relies on third-party infrastructure and may occasionally be unavailable.

5. User Conduct

You agree not to use the App to:

• Upload or generate illegal, harmful, or objectionable content.
• Process images of individuals without their consent.
• Reverse-engineer or decompile the App or its AI systems.
• Use automated systems to access the AI features.

6. Intellectual Property

The App is the property of Imagnet and is protected by intellectual property laws. You retain ownership of your original photos. For AI-transformed images, you are granted a non-exclusive license to use the output for any lawful purpose.

7. Disclaimer of Warranties

THE APP AND AI SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGNET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Refund Policy

All purchases are processed by Apple. Refund requests must be submitted directly to Apple. Unused AI credits do not expire as long as your account remains active.

10. Termination

We reserve the right to suspend or terminate your access to the App for conduct that violates these Terms.

11. Changes to Terms

We may update these Terms from time to time by posting the new Terms on this page.

12. Governing Law

These Terms shall be governed by the laws of the State of Israel.
